About Us

Our Role in Divorce

Our role as a Certified Divorce Financial Analyst:

We act as a neutral financial professional to either a couple or individual who may already be in the divorce process of mediation, collaborative or litigation. We help to clarify income available for spousal and child support, identify all monthly expenses and develop a realistic budget. It is important to take time to be accurate with the numbers and not omit any monthly expenses or any major expenses that may be looming. What if you agree to accept less support than is really needed? What if you agree to support payments that you cannot really pay? What if one spouse agrees to keep the house in place of a future pension for example and then cannot afford the ongoing maintenance required on the house? What if one spouse does not have retirement funds put away? What if future taxes are due on an asset that was not considered when divided? Did one spouse have separate property that should have been financially identified? We can help with these issues and more.

Although we do not provide legal advice or legal documents, our expertise can help cut the cost of a long court proceeding by paving the way to a fair settlement for each spouse. We can become part of the professional team (attorney, therapists etc.) to financially evaluate different settlement options. We are aware of the specific tax laws that apply to divorce and have background knowledge of the legal issues in divorce. When investments are involved, we can evaluate them as to their cost basis and the tax liability if they are sold. In other words, we help to identify which asset and liability is the best and most suitable for one spouse to have going forward versus the other spouse.

Your Divorce is Final - Now What

  James R. Allen, CFP®

Even though your divorce is now final, that isn’t the end of the work involved. Your marital settlement agreement may spell out the terms of your property division but there are many things that you will still need to accomplish. Listed below is a post-divorce checklist of things that will still need to be done:

· Make sure any retirement or pension plans get divided using a qualified domestic relations order (QDRO).

· Get your estate documents (will, trust, power of attorney, health care directive) updated.

· Make sure all insurance, annuity and retirement plan beneficiaries are updated.

· Close all joint credit cards and establish new ones in your name. Same with bank and investment accounts.

· Notify your employer’s human resource department to update health insurance plans.

· You may also need to change your income tax withholding since you will be filing single.

· Develop a financial plan for your post-divorce life.

After the divorce is final, many of these items fall through the cracks. Staying on top of these will save you in terms of headache and cost. Our job is to assist you with the transition to your new life.

FAQs

How is divorce financial analysis different than financial planning?

With divorce financial analysis, our role is to identify and value assets, liabilities, income and expenses that are involved in a divorce and analyze the impact of how these are divided so that our client and or their attorney can make an informed decision as to whether the division is equitable. We are not providing any recommendations, but are simply providing information.

With the financial planning process, we do make recommendations as to courses of action that may be of benefit to the client. While we are engaged in the divorce analysis process, we do not provide financial planning services to the client. Once the divorce analysis engagement has ended, we can provide post divorce financial planning through our affiliated company Sterling Wealth Partners.
